DUTIES: The Assistant General Counsel and Records
Compliance Officer shall be responsible to the Vice President and General
Counsel and provide counsel to the University in its information documentation,
privacy, and security practices as well as assist in the University’s contracting
processes.
Selection to this position requires the prior
approval of both the Board of Trustees of The University of Akron and the
Ohio Attorney General. Upon approval by the Ohio Attorney General,
the individual in this position will be appointed an Assistant Attorney
General, in accord with a Memorandum between the Ohio Attorney General
and The University of Akron.
In connection with federal laws such as FERPA,
HIPAA, and GLBA and applicable state laws such as the Ohio Public Records
Law, this individual shall assist in developing the University’s response
to new federal legislation in achieving compliance with its long-standing
privacy policies and practices. Responsibilities shall include gathering
requested information, assisting with the proper redaction of information
from those records, and providing for the inspection of such information
by the requestor or furnishing copies to the requestor. In order
for the University to comply fully with Ohio’s Public Records Act, this
individual shall have full authority to gather such information as is necessary
to comply with the request. This individual shall report to the Vice
President and General Counsel and shall provide advice and counsel with
respect to: records compliance requirements as necessary, records
archive matters, or other such matters as directed by the Vice President
and General Counsel.
This individual shall also be responsible for
the oversight of all electronic records retention and destruction pursuant
to the University’s Electronic Records Retention Policy (O.A.C. 3359-11-11.1).
This individual also will be responsible for
negotiating, drafting, reviewing, editing, and approving University contracts
and agreements and assisting with the operation of contract administration
and procedures as well as perform additional duties as assigned.
The Assistant General Counsel is under the general
supervision of the Ohio Attorney General and the direct supervision of
the Vice President and General Counsel and the Associate Vice President
and Associate General Counsel.
QUALIFICATIONS: Candidates must have a
professional law degree (J.D. or L.L.B.) from a law school accredited by
the American Bar Association. Candidates must be in good standing
to practice law by the Supreme Court of Ohio. A minimum of five years
of professional legal experience is required. Previous work experience
in public higher education or other relevant public employment is preferred.
Candidates must possess strong communication, analytical, and research
skills. The ability to organize time and tasks to effectively manage
a heavy workload, flexibility, and a collegial disposition are essential
attributes. The ability to conduct legal research, communication,
