...I'm having a party and people who are not invited walk in the house?
Whenever someone comes in your house that you don't want there, you should ask them to leave. If they refuse, you should call the city police at 375-2181 or UAPD at 972-7123.
...I'm having a party and there are people under 21 getting beer from the keg or drinking alcohol they brought with them? Am I responsible for that and what should I do?
You are held responsible for underage persons who are drinking or possess alcohol on your property whether you provided it or not. If you want underage people at the party, you should have somebody actively serving the alcohol who checks IDs.
...the police see my friends who are under 21 drinking on my property? The police may arrest them for underage consumption and/or possession of alcohol and arrest you for providing it or allowing it to occur.
...my friends are arrested and charged with "keeper of the place" or "allowing underage consumption" what is that? This offense states that the host/hostess provided or permitted underage consumption or possession of alcohol on their property.
...I'm having a party with a band or a D.J. All of my neighbors said that the noise wouldn't bother them. I don't have to worry about it being too loud then, do I? Yes, you do. If it is prior to 9 p.m. and the police department receives complaints about the noise, the party givers can be charged with violating the noise ordinance. If it is after 9 p.m., a police officer can enforce the Sound Amplifying Device Ordinance without citizen complaints if the music can be heard from 80 feet away. There is also a noise ordinance, which prohibits noise producing instruments from disturbing the peace and good order at any time of day or night. How far away is 80 feet from my house? The average city lot in Akron is 40 feet so 80 feet would be only two houses away.
….people just walk up and join my party, how can I avoid this? Successful parties in the off campus fence off their property and have someone check for IDs or an invitation at the gate. They put a wristband on guests who are 21 and over and able to drink alcohol. Additionally, someone then serves the alcohol and they check for wristbands and double check for IDs.
…somebody at my party causes a problem and I want them to leave? First, ask the person to leave. If they refuse, call the police and they can arrest the person for trespassing. Will the police end the party? No, not if there aren't any law violations and the party is under control.
... someone uses a fake ID to show they are 21 years of age or older? Party hosts are liable for anyone consuming alcohol at their party. Therefore, the host may still be arrested for "Keeper of the Place", even if the ID is fake.
Frequently Asked Questions
Why are the police being so tough on students and arresting so many people? Until the year 2000, the frequent police response to many law violations was to warn people about open containers, loud music and underage consumption. The police also tried to get people to police their own parties. As a result the warnings were ineffective and lead to the injury of students and damage to property.
Why are the police telling us what they can arrest us for? It is a pro-active approach for the police to work with students to help them to party responsibly. It is also to open the lines of communication between students, non-student residents, police, The University of Akron and the City of Akron.
Don't the police realize that we are just college students doing what we are supposed to at this age? The police department is not discouraging parties. However, those that host or attend parties must do so responsibly. Irresponsible and destructive behavior not only affects the students but the surrounding neighborhood and the University and community as a whole.
What is the diversion program? It is a program in which an offender can have a misdemeanor offense removed from his/her record if they successfully complete the program. There are some stipulations. The court does not have to accept everyone into the program. Individuals can only participate in the program once. There is a cost of $175 to enter the program and the individual must attend five one-hour class sessions.
Can I be arrested for not leaving an area when told to by an officer? Yes, you may be arrested for failure to disperse and/or disorderly conduct.
What about the other problems in the neighborhood, such as thefts and damaging to cars? The police are encouraging area residents to be sure to lock up items of value in the trunk of their car or take them in the house. These crimes are frequently a result of opportunity. With a little awareness, residents may avoid becoming victims of these crimes.
